- The Service will be free from errors, bugs, or security vulnerabilities
- Results obtained through use of the Service will be accurate, reliable, complete, current, or fit for any particular purpose
- Any defects in the Service will be corrected
- Algorithmic or automated outputs will be error-free, consistent, or suitable for your specific circumstances
10. Limitation of Liability
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SCAPELENS, ITS OPERATORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- Your use of or inability to use the Service
- Any inaccurate flight data, schedules, routing information, or analytical outputs
- Any decision made or action taken in reliance on information provided by the Service
- Unauthorized access to or alteration of your data
- Any third-party content, services, or conduct
- Any other matter relating to the Service
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT PAID BY YOU, IF ANY, TO ACCESS THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) EUR 100.
11. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Scapelens, its operators, affiliates, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any applicable law or the rights of any third party
This section does not apply to the extent a claim arises from our own fraud, willful misconduct, or other liability that cannot be excluded under applicable law.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, where reasonably necessary to protect the Service, users, our rights, or to address suspected abuse, legal risk, or violations of these Terms.
Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination, including those relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution, will continue to apply.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws applicable to Scapelens, without regard to conflict of law principles, except to the extent mandatory consumer protection laws require otherwise.
Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation.
If you are an EU consumer, you retain any mandatory consumer protections afforded by the laws of your country of residence, and you may bring claims in the courts of your place of residence where required by applicable law.
If you are not an EU consumer, disputes may be resolved through binding arbitration or in the courts of competent jurisdiction, as permitted by applicable law.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be interpreted to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Scapelens regarding the use of the Service and supersede any prior agreements relating to the same subject matter.
